Terms of Service

These terms govern animatica.ai, the Animatica web app, Animatica Cloud and the Animatica plugins: Animatica Choreographer and Animatica Marionette for Blender, and the plugins for Autodesk Motion Builder and Autodesk 3ds Max (together, the service), operated by PANTOMIM P.S.A., ul. Jana Matejki 9/6, 80-252 Gdańsk, Poland. By creating an account or installing a plugin you accept them.

1. The plugins, Animatica Cloud and plans

Animatica Choreographer and the plugins for Motion Builder and 3ds Max generate motion and are free. Animatica Marionette, which poses and edits motion by hand, is a one-time purchase of $59; a launch price, where one is offered, is shown at the point of sale. Its licence is summarised on the Licenses page, and these terms govern its use. A Marionette licence is for one user and includes the updates released in the 12 months after purchase. When they end you may keep using the last version you received; further updates can be renewed but do not have to be. Marionette runs on your machine: it needs no account or connection to work and never uses a generation.

Animatica Cloud generates motion on our GPUs, for the plugins and for any MMCP client, from an account on app.animatica.ai. Free costs $0 and includes 10 generations per month on every account. Pay as you go is a one-time purchase of a pack of 50 generations for $5. A pack is not a subscription and does not renew; pack generations are used once the monthly allowance is spent, and do not expire. Pro costs $20 per month, or $200 per year paid in advance, and includes 500 generations per month. Pro paid yearly also includes a Marionette licence on the same terms as buying one. Pro includes priority access to new models and support. These depend on available capacity and are not a guaranteed service level. Teams costs $40 per seat per month, includes a Marionette licence for each seat while the subscription lasts, and shares one generation pool across the team. Enterprise is priced on a custom agreement. Monthly allowances reset each billing month and do not carry over; pack generations are not affected. When all of an account’s generations are used up, further generations are blocked until the next month begins or another pack is bought.

2. Your account

You need an account to use Animatica Cloud or to buy on app.animatica.ai, and you must be at least 18 years old to have one. Give us accurate details, keep your credentials to yourself, and tell us if you think someone else has got hold of them. Activity under your account is treated as yours. Accounts are personal; a Teams agreement is what covers shared use inside an organisation.

3. Acceptable use

Do not resell raw access to the service, work around allowances or rate limits, or try to extract, retrain or reverse engineer the models behind it. Do not submit material you have no right to submit, and do not use the service to produce content that is unlawful, that infringes someone else’s rights, or that depicts a real person without their permission. We may suspend an account that breaks these rules, and will explain why when we do.

4. Your inputs and the motion you generate

You keep whatever rights you already hold in the inputs you submit. As between you and us, we claim no ownership of the motion generated from them, and on any plan and with any plugin you may use that motion in commercial work. Poses and motion you make with Marionette are yours, and stay on your machine. To run a generation and return the result we need a limited licence to process your inputs and store the output for you; we do not use it to train models without your separate agreement. That licence runs no further than operating and improving the service, debugging a failed generation for instance, and it ends with your account.

5. Payment

Marionette bought through a reseller we have authorised, such as a marketplace, is paid for under that store’s terms, which cover its payment, tax and refunds. Everything bought on app.animatica.ai goes through our payment provider: one-time purchases are charged when you buy them, and subscriptions are billed in advance, monthly or yearly. Prices there are shown exclusive of VAT, which we add where it applies. You can cancel a subscription at any time. Your plan then runs to the end of the period you have already paid for and does not renew. We do not refund part-periods except where the law requires it. If a payment fails, the account falls back to the Free allowance until it succeeds.

6. The self-hosted backbone

The Animatica backbone and the MMCP protocol are open source under the Apache License 2.0. Running them yourself is governed by that licence, not by these terms, and needs no account with us. See the Licenses page. The plugins that talk to a self-hosted backbone are still licensed under these terms.

7. Early access, warranties and liability

The service is in early access and is provided “as is”. We do not warrant that generated motion will be fit for any particular production, and we may change or withdraw features as the product develops. We will give notice before removing something you depend on. To the fullest extent the law allows, our total liability is limited to what you paid us in the twelve months before the claim, and we are not liable for indirect or consequential loss, lost profit or lost data. Nothing here limits liability that cannot be limited by law, including your statutory rights as a consumer. We do not guarantee uninterrupted access, and we may modify or suspend part of the service; where a change is material we will make reasonable efforts to tell you first.

8. Changes, termination and governing law

We may update these terms; the “last updated” date above changes with them and we announce material changes before they take effect. You can close your account at any time, and we may suspend or close one that breaks these terms or harms the service or its users. When an account ends your right to use the service ends with it, and we delete your data on the schedule set out in the Privacy Policy. These terms are governed by Polish law, and disputes go to the courts competent for the seat of PANTOMIM P.S.A. in Gdańsk, without affecting the protection consumers have under the law of their own country.
